Engagement agreement terms and conditions

This Engagement Agreement is made up of three parts and these Terms and Conditions should be read with the other two sections, Part 1 – Party Information and Part 2 – Authority to Act.

These Terms and Conditions are part of the legal agreement and provide information about how services will be delivered and the rights and responsibilities of each party involved in the agreement – you and Cash Tracer.

The Terms and Conditions are subject to change and if that happens, you will be provided with seven (7) days notice in writing.

These Terms and Conditions include information about the following topics:

1.1 Cash Tracer is the business carrying out the service searches and/or money recovery on behalf of you, the Client.

1.2 On accepting the Engagement Agreement, you are engaging Cash Tracer to undertake the service searches and/or money recovery. You accept the Engagement Agreement by completing Part 1 – Party Information, and Part 2 – Authority to Act sections of the Engagement Agreement and in doing this, you are acknowledging this section, Part 3 – Terms and Conditions.

1.3 Cash Tracer agrees to act in the role of sole agent on your behalf to find, verify and recover lost and unclaimed money and superannuation in accordance with the directions provided by you through the Engagement Agreement.

1.4 Cash Tracer holds an Investigations – Collections Work license and qualifications to deliver search and money recovery services to you.

1.5 In accepting the Engagement Agreement, you are aware of your rights and responsibilities and agree to fully comply. This includes providing Cash Tracer with relevant true and genuine documentation and evidence to prove your identity and current and past contact information, that will allow Cash Tracer to appropriately act on your behalf.

1.6 These Terms and Conditions of the Engagement Agreement are subject to change and if a change is made between your acceptance of the Engagement Agreement and before the service(s) have been fully executed by Cash Tracer, you will be provided with seven (7) days written notice of the change.

2.1 Searches on your behalf

2.1.1 In approaching Cash Tracer yourself, you authorise Cash Tracer to undertake any searches and processes required to investigate lost and unclaimed money on your behalf.

2.1.2 Cash Tracer will search all Australian government jurisdiction’s unclaimed money registers. In writing, you can choose to narrow the search field and specify the jurisdictions that Cash Tracer searches.

2.1.3 At an agreed time, Cash Tracer will also step you through the process to search for unclaimed Superannuation, through government platforms.

2.1.4 You acknowledge that Cash Tracer will require you to provide true and genuine documentation to confirm and evidence your identity and current and past contact information, as it relates to undertaking searches on your behalf. 

 

2.2 Lost and unclaimed money recovery service

2.2.1 You will be approached by Cash Tracer if through regular searches and investigations, you have been identified as a potential match to money listed on an Australian unclaimed money register, or other holding authority. In approaching you, Cash Tracer will invite you to use the lost and unclaimed money recovery service. 

2.2.2 Based on consideration and in accepting the Engagement Agreement you acknowledge that:

2.2.2.1 Cash Tracer will not disclose the source of the lost or unclaimed money. The service will not begin until you have accepted the Engagement Agreement, in writing.

2.2.2.2 You authorise Cash Tracer to undertake any searches and processes required to further investigate and recover lost and unclaimed money. 

2.2.2.3 You acknowledge that Cash Tracer will require you to provide true and genuine documentation to confirm and evidence your identity and current and past contact information, as it relates to undertaking the money recovery service.

2.2.2.4 Cash Tracer will act on your behalf and with your authority, to obtain personal information from third parties, if required in the process to recover lost money.

2.2.2.5 You authorise Cash Tracer to prepare, submit claims and liaise with relevant holding authorities, including sharing your information with them, required to recover lost money. 

2.2.2.6 Cash Tracer will direct the authority holding a relevant parcel of money to transfer it to the Cash Tracer Client Trust Account. Cash Tracer will then take the agreed Service Fee and disperse the remaining amount of recovered funds to a location of your choice via electronic transfer or bank cheque.

3.1 Cash Tracer agrees to use the information provided by you only for recovering money on your behalf. Cash Tracer will comply with the Cash Tracer Privacy Policy, available on the Cash Tracer website www.cashtracer.com.au.

3.2 In undertaking the service, Cash Tracer will take appropriate measures to comply with any law or regulation relevant to undertaking the service. As a business located in Adelaide, South Australia, the laws of this state govern the Engagement Agreement and the parties submit to the non-exclusive jurisdictions of the courts of South Australia and the Federal Court of Australia.

3.3 With all relevant documents and information evidencing identify and current and past contact information, Cash Tracer seeks to have finalised the recover process within 90 days of acceptance of the Engagement Agreement. If this timeframe is not able to be met due to external parties processing or other events, Cash Tracer will make you aware in writing of any delays being experienced. 

3.4 Cash Tracer does not offer a financial advisory service and you will not provide you with financial advice.

4.1 You agree to provide true and accurate information in completing all aspects of this Engagement Agreement.

4.2 You agree to provide true and genuine documents that confirm and evidence your identity and current and past contact information, as it relates to recovering lost money on your behalf. You also agree to have these documents certified by a Justice of the Peace or relevant authority, if required for the purpose of recovering the lost money.

4.3 You agree to provide Cash Tracer with all relevant true and genuine documents as they are needed throughout the lost money recovery process, within seven (7) days of a written request. Cash Tracer is not accountable for the delay or failure to recover lost money, due to your failure to provide relevant, true and up-to-date information as and when it is requested.

4.4 You agree to not deal directly with the unclaimed money register and/or money holding authority, or engage the services of another provider from the point of acceptance of this Engagement Agreement.

5.1 Cash Tracer will begin the service you have chosen from the date the Engagement Agreement is accepted.

5.2 From Engagement Agreement acceptance, Cash Tracer will undertake the service until an outcome has been confirmed, including:

5.2.1 Searches on your behalf have been completed.

5.2.2 Lost and unclaimed money recovery has been undertaken and recovered money has been disbursed to you.

5.3 If for any reason outside Cash Tracer’s control, it is not possible to meet 5.2, this will be communicated to you and the service will cease. Cash Tracer cannot guarantee that any amount can be reclaimed.

5.4 Service fees

5.4.1 For searches on your behalf:

5.4.1.1 You agree to pay $65 plus GST (Goods and Services Tax) at the time of accepting the Engagement Agreement. 

5.4.1.2 If you choose, a Cash Tracer team member will step you through how you can search for lost Superannuation at an agreed time. 

5.4.1.3 At the conclusion of all searches, you will be provided with a report of the search outcomes.

5.4.1.4 If lost or unclaimed money has been located, Cash Tracer will begin the recovery process of this money. You agree to pay 12% plus GST (Goods and Services Tax) of the money being recovered, subject to a minimum fee of $400 plus GST (Goods and Services Tax), less the $65 plus GST (Goods and Services Tax) you have already paid.

5.4.2 For lost and unclaimed money recovery, you agree to pay 12% plus GST (Goods and Services Tax) of the money being recovered, subject to a minimum fee of $400 plus GST (Goods and Services Tax). The amount you pay as your service fee is included within Part 1 of the Engagement Agreement.

5.4.3 You acknowledge that the recovered money will be deposited into the Cash Tracer Client Trust Account.

5.4.4 You authorise Cash Tracer to deduct the service fee from the recovered money in the Cash Tracer Client Trust Account and to transfer the balance to you by Electronic Fund Transfer (EFT) to your nominated account, as you have outlined within the Engagement Agreement or a bank cheque, at your cost.

5.4.5 If the holding authority policy is to send the lost money directly to you, you agree to pay the service fee due to Cash Tracer within seven (7) days of the money being received from the holding authority. Cash Tracer will issue you with an invoice detailing the amount payable and different methods of payment.

5.5 Cash Tracer is entitled to issue you with an invoice, payable within seven (7) days, for the Service Fee and any costs incurred, including legal costs, that Cash Tracer would have otherwise collected on the recovery of lost or unclaimed by Cash Tracer, if you had not:

5.5.1 Knowingly withheld the necessary information or documentation as required by Cash Tracer to successfully recover lost or unclaimed money;

5.5.2 Engaged the services of another service provider undertaking the same work while being in an Engagement Agreement with Cash Tracer;

5.5.3 Dealt directly with the holding authority to recover the lost or unclaimed money.

6.1 Cash Tracer will not be liable for any loss arising from a delay caused by you, including failure to provide true and genuine documentation required to recover lost or unclaimed money.

6.2 Cash Tracer will not be liable for any matters outside its control including holding authority processing times.

6.3 Cash Tracer cannot warrant the accuracy or completeness of any information provided by any third party. In providing you with information regarding lost or unclaimed money possibly due to you, Cash Tracer has relied entirely upon information provided by holding authorities and Cash Tracer will not be liable for any loss arising from this.

7.1 Cash Tracer can terminate the Engagement Agreement at any time by providing seven (7) days notice in writing.

7.2 You can terminate the Engagement Agreement at any point after 90 days from when it was first accepted. Your termination needs to be provided to Cash Tracer in writing.

Privacy Policy
